Copies of the staff reports or other written documentation relating to each item of business referred to on the agenda are on file in the office of the City Clerk and are available for public inspection. If applicable, materials related to an item on this agenda submitted to the Council after distribution of the agenda packet are available for public inspection in the City Clerk's office during normal business hours. Any person having any question concerning any agenda item may call the City Clerk to make inquiry concerning the item. Upon request, the agenda and documents in the agenda packet can be made available in appropriate alternative formats to persons with a disability in compliance with the Americans with Disabilities Act. The City Council welcomes and encourages public participation at the Council meetings; however, to allow for the orderly progression of business, each person wishing to comment or make a presentation shall be limited to up to three (3) minutes. Anyone wishing to address the City Council is requested to fill out a green speaker's card available at the entry of the meeting room. The card permits the City to identify persons for purposes of City Council minute preparation. Please see specific agenda sections below for any other requirements related to meeting participation. The City Council, at the direction of the Mayor with concurrence of the Council, may modify the order of items shown on the agenda.

Recommendation: The City Treasurer recommends that the City Council receive and file the Palos Verdes Estates Quarterly Cash & Investment Report for the quarter and fiscal year ending on June 30, 2024. |

Recommendation: Staff recommends that the City Council approve the minutes for the following meetings: February 6, 2024, February 7,2024; February 13, 2024; February 27, 2024; February 28,2024; March 4, 2024; March 6, 2024; May 23, 2024; June 25, 2024; July 23, 2024; and December 5, 2024. |

PLANNING COMMISSION MEETING ACTIONS
Recommendation: Staff recommends that the City Council approve the minutes for the Planning Commission meetings of September 11, 2024 and September 17, 2024. |

TRAFFIC SAFETY COMMITTEE MEETING ACTIONS
Recommendation: Staff recommends That the City Council approve the Traffic Safety Committee Action Minutes of the September 4, 2024 meeting. |

ADOPTION AND SECOND READING OF ZTA-002-24; ZONING TEXT AMENDMENT AMENDING CHAPTER 18.36 NEIGHBORHOOD COMPATIBILITY OF TITLE 18 ZONING REGULATIONS OF THE PALOS VERDES ESTATES MUNICIPAL CODE TO CLARIFY THE DEFINITION OF A NEW STRUCTURE AND FOR PURPOSES OF NEIGHBORHOOD COMPATIBILITY REVIEW AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
Recommendation: Staff recommends that the City Council adopt Ordinance No. 764 to waive further reading and read by title only: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALOS VERDES ESTATES, CALIFORNIA AMENDING CHAPTER 18.36 NEIGHBORHOOD COMPATIBILITY OF TITLE 18 ZONING REGULATIONS OF THE PALOS VERDES ESTATES MUNICIPAL CODE TO CLARIFY THE DEFINITION OF A NEW STRUCTURE AND FOR PURPOSES OF NEIGHBORHOOD COMPATIBILITY REVIEW AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) |

APPROVAL OF THE GOOD NEIGHBOR PLEDGE THROUGH THE SOUTH BAY CITIES COUNCIL OF GOVERNMENTS IN RESPONSE TO THE JOHNSON V. GRANTS PASS SUPREME COURT RULING
Recommendation: It is recommended that the Mayor and City Council adopt and approve the Good Neighbor Pledge (Attachment A). |

CONFLICT OF INTEREST CODE - BIENNIAL NOTICE AND AMENDMENT |
Recommendation: It is recommended the City Council:
1. |
Receive and file the biennial notice; and |
2. |
Review and adopt proposed Resolution No. R24-47 amending the City’s Conflict of Interest Code. |

ADOPT A RESOLUTION TO APPROVE THE PLANS AND SPECIFICATIONS FOR THE FISCAL YEAR 2023-2024 ANNUAL STREET IMPROVEMENT PROJECT (PW-701-23); AWARD A CONSTRUCTION CONTRACT TO ALL AMERICAN ASPHALT IN THE AMOUNT OF $1,176,900.00; APPROVE ADDITIONAL CONSTRUCTION EXPENDITURES NOT TO EXCEED $117,690.00, WHICH IS APPROXIMATELY 10% OF THE CONSTRUCTION CONTRACT AMOUNT; AUTHORIZE THE CITY MANAGER TO EXECUTE ALL CONTRACT DOCUMENTS; AND AUTHORIZE THE CITY CLERK TO RECORD THE NOTICE OF COMPLETION UPON ACCEPTANCE OF THE WORK BY THE INTERIM PUBLIC WORKS DIRECTOR |
Recommendation: That the City Council adopt the Resolution to:

Approve the plans and specifications for the Fiscal Year (FY) 2023-2024 Annual Street Improvement Project (City Project No. PW-701-23); |
2. |
Award a construction contract to All American Asphalt in the amount of $1,176,900.00; |
3. |
Approve additional construction expenditures not to exceed $117,690.00, which is approximately 10% of the construction contract amount; |
4. |
Authorize the City Manager to Execute all Contract Documents; and |
5. |
Authorize the City Clerk to Record the Notice of Completion upon Acceptance of the Work by the Interim Public Works Director |

TRANSFER AGREEMENT BETWEEN LOS ANGELES COUNTY FLOOD CONTROL DISTRICT AND PALOS VERDES ESTATES, SAFE, CLEAN WATER PROGRAM - MUNICIPAL PROGRAM AGREEMENT NO. 2024MP57
Recommendation: It is recommended that the City Council approve City Council Resolution R24-48 approving Transfer Agreement No. 2024MP57 between the Los Angeles County Flood Control District and Palos Verdes Estates and authorizing the City Manager to execute the agreement in the final form and format as approved by the City Attorney. |

APPROVE SPECIAL EVENT APPLICATION FOR DIWALI LUNADA BAY’S FESTIVAL OF LIGHTS ON NOVEMBER 2 AT LUNADA BAY PARK
Recommendation: Staff recommends that the City Council approve the Special Event Application for the Diwali Lunada Bay's Festival of Lights event to be held at Lunada Bay Park on Saturday, November 2 from 5:00 PM to 8:00 PM. |

MALAGA LANE WATER INTRUSION AND SUBSURFACE INVESTIGATION
Recommendation: Staff recommends that the City Council receive an update on the Malaga Lane water intrusion and subsurface investigation and provide directions to staff. |

CITY COUNCIL DISCUSSION ON CONSIDERATION OF MOVING FORWARD ON PAID PARKING CONCEPTS
Recommendation: It is recommended that the City Council discuss and provide direction to staff in regard to moving forward with a paid parking program. |
