Copies of the staff reports or other written documentation relating to each item of business referred to on the agenda are on file in the office of the City Clerk and are available for public inspection. If applicable, materials related to an item on this agenda submitted to the Council after distribution of the agenda packet are available for public inspection in the City Clerk's office during normal business hours. Any person having any question concerning any agenda item may call the City Clerk to make inquiry concerning the item. Upon request, the agenda and documents in the agenda packet can be made available in appropriate alternative formats to persons with a disability in compliance with the Americans with Disabilities Act. The City Council welcomes and encourages public participation at the Council meetings; however, to allow for the orderly progression of business, each person wishing to comment or make a presentation shall be limited to up to three (3) minutes. Anyone wishing to address the City Council is requested to fill out a green speaker's card available at the entry of the meeting room. The card permits the City to identify persons for purposes of City Council minute preparation. Please see specific agenda sections below for any other requirements related to meeting participation. The City Council, at the direction of the Mayor with concurrence of the Council, may modify the order of items shown on the agenda.

This portion of the agenda is reserved for comments from the public on items which are NOT on the agenda. CONSENT AGENDA (ITEMS 1-4)

1. APPROVAL OF WARRANTS

Recommendation: Review and Approve Warrant Registers of August 6, 2024, August 20,2024 and September 10, 2024


2. RECEIVE AND FILE FINANCIAL STATEMENTS FOR THE PERIOD ENDING JUNE 30, 2024, AND JULY 31, 2024

Recommendation: Staff recommends that the City Council receive and file the financial statements for the month ending June 30, 2024, and month ending July 31, 2024.


3. CITY COUNCIL MEETING ACTIONS

Recommendation: Staff recommends that the City Council approve the minutes for the following meetings: October 10, 2023, October 24, 2023, November 1, 2023, November 14, 2023, November 27, 2023, November 28, 2023, December 12, 2023, July 23, 2024, and August 30, 2024.


4. RESOLUTION NO. 24-46 AUTHORIZING THE CITY MANAGER TO ENTER INTO THE SETTLEMENT AGREEMENT WITH KROGER CO., REVERT FUNDS TO THE COUNTY OF LOS ANGELES, AND TO EXECUTE ANY DOCUMENTS NECESSARY TO IMPLEMENT THE ACTION

Recommendation: Staff recommends that the City Council adopt the proposed resolution and direct the City Manager or designee to enter into the Kroger settlement agreement, direct the settlement funds to Los Angeles County for opioid abatement purposes, and authorize the City Manager or designee to execute any documents necessary to implement the action.



PUBLIC HEARING

5. INTRODUCTION AND FIRST READING OF ZTA-002-24; ZONING TEXT AMENDMENT AMENDING CHAPTER 18.36 NEIGHBORHOOD COMPATIBILITY OF TITLE 18 ZONING REGULATIONS OF THE PALOS VERDES ESTATES MUNICIPAL CODE TO CLARIFY THE DEFINITION OF A NEW STRUCTURE FOR AND FOR PURPOSES OF NEIGHBORHOOD COMPATIBILITY REVIEW AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)

Recommendation: City Council open the public hearing, receive input, and introduce Ordinance No. 764 entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALOS VERDES ESTATES, CALIFORNIA AMENDING CHAPTER 18.36 NEIGHBORHOOD COMPATIBILITY OF TITLE 18 ZONING REGULATIONS OF THE PALOS VERDES ESTATES MUNICIPAL CODE TO CLARIFY THE DEFINITION OF A NEW STRUCTURE FOR AND FOR PURPOSES OF NEIGHBORHOOD COMPATIBILITY REVIEW AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)



OLD BUSINESS

6. ADOPT RESOLUTION R24-45 TO APPROPRIATE $79,894 IN UNEMCUMBERED GENERAL FUNDS (FUND 01) TO RETAIN GEOSYNTEC TO PERFORM ADDITIONAL INVESTIGATORY SERVICES.

Recommendation: That the City Council adopts Resolution R24-45 to appropriate $79,894 in unencumbered General Funds (Fund 01) to retain Geosyntec to perform additional investigatory services.



7. APPROVE BUDGET AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF PALOS VERDES ESTATES AND VASQUEZ & COMPANY, LLP TO PROVIDE AUDIT SERVICES FOR THE FINANCE DEPARTMENT FOR FISCAL YEAR 2022-2023

Recommendation: Staff recommends the City Council approve a budget adjustment to the professional services agreement with Vasquez & Company for professional independent audit services for the Fiscal Year 2022-23 (Increase the Fiscal Year 2024-25 budget from $65,000 to $94,900 to finish paying for the Fiscal Year 2022-2023 audit).


8. ADOPTION OF RESOLUTION NO. R24-42 UPDATING THE PROCEDURES FOR ROTATION OF THE POSITION OF MAYOR AND MAYOR PRO TEMPORE.

Recommendation: That the City Council adopt resolution No. R24-42, the Procedure for Rotation of the Positions of Mayor and Mayor Pro Tempore and rescind Resolution No. 23-49.


NEW BUSINESS

9. CONSIDER PROPOSALS FOR HOUSING ELEMENT SITES INVENTORY REZONING AND CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) COMPLIANCE

Recommendation: Staff recommends that the City Council:

1. Consider Housing Element Sites Inventory Rezoning and CEQA Compliance proposals from CSG Consultants and De Novo Planning Group; and

2. Approve an Agreement with CSG Consultants to assist with the Housing Element Sites Inventory Rezoning and CEQA compliance; and

3. Adopt Resolution No, R24-44, approving an appropriation in the amount of $92,145 from the General Fund Reserve for the agreement


10. CONSIDERATION OF RECEIVING A DONATION FROM THE PALOS VERDES ESTATES FOUNDATION FOR 20 AUTOMATED LICENSE PLATE RECOGNITION CAMERAS TO BE INSTALLED AT DESIGNATED LOCATIONS WITH A MONETARY VALUE ESTIMATED AT $466,210.

Recommendation: Staff recommends that the City Council:

1. Approve the project concept and accept the donation of ALPR technology from the Palos Verdes Estates Foundation, valued at $466,210.33;

2. Authorize the City Manager and City Attorney to execute the proposed agreement between the City, the Palos Verdes Estates Foundation and Motorola Solutions; and

3. Waive the permit fees and right-of-way expenses not to exceed $30,000.00


11. REVENUE ENHANCEMENT AD HOC COMMITTEE REPORT OF ACTIVITY

Recommendation: Receive and File.

This portion of the agenda is reserved for the Mayor and Councilmembers to provide comments, reports on community activities, ad hoc committees, and propose topics to be calendared on a future Council agenda.
