Copies of the staff reports or other written documentation relating to each item of business referred to on the agenda are on file in the office of the City Clerk and are available for public inspection. If applicable, materials related to an item on this agenda submitted to the Council after distribution of the agenda packet are available for public inspection in the City Clerk's office during normal business hours. Any person having any question concerning any agenda item may call the City Clerk to make inquiry concerning the item. Upon request, the agenda and documents in the agenda packet can be made available in appropriate alternative formats to persons with a disability in compliance with the Americans with Disabilities Act. The City Council welcomes and encourages public participation at the Council meetings; however, to allow for the orderly progression of business, each person wishing to comment or make a presentation shall be limited to up to three (3) minutes. Anyone wishing to address the City Council is requested to fill out a green speaker's card available at the entry of the meeting room. The card permits the City to identify persons for purposes of City Council minute preparation. Please see specific agenda sections below for any other requirements related to meeting participation. The City Council, at the direction of the Mayor with concurrence of the Council, may modify the order of items shown on the agenda.

CONSENT AGENDA (ITEMS 1-8)

1. WARRANTS

Recommendation: Recommendation: Review and Approve Warrant Registers of February 27,2024.



2. APPROVE SPECIAL EVENT APPLICATION FOR THE PENINSULA EDUCATION FOUNDATIONS’ "TOAST ON THE COAST" FUNDRAISING EVENT SCHEDULED FOR SATURDAY OCTOBER 05, 2024 FROM 2:00PM TO 10:00PM.

Recommendation: Staff recommends approval of the Special Event Application submitted by the Peninsula Education Foundation for their "Toast on the Coast" fundraising event on Saturday, October 5, 2024.


3. ACTIONS OF THE FEBRUARY 20, 2024, MEETING OF THE PLANNING COMMISSION. Recommendation: Receive and file.


4. INITATE A ZONING TEXT AMENDMENT TO THE PALOS VERDES ESTATES MUNICIPAL CODE CHAPTER 17.08 TO ADD A DEFINITION DEFINING WHEN AN EXISTING STRUCTURE IS NEW CONSTRUCTION OR REMODEL/ALTERATIONS CONSTRUCTION

Recommendation: Staff recommends that the City Council adopt City Council Resolution No. R24-11 to initiate Zoning Text Amendment to the Palos Verdes Estates Municipal Code Chapter 17.08 to add a definition when an existing structure is new construction or remodel/alterations construction.


5. APPROVE SECOND AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF PALOS VERDES ESTATES AND MV CHENG & ASSOCIATES TO PROVIDE SERVICES FOR THE FINANCE DEPARTMENT FOR FISCAL YEAR 2023-2024.

Recommendation: That the City Council authorize the City Manager to sign the Second Amendment to the Professional Services Agreement between the City of Palos Verdes Estates and MV Cheng & Associates in order to:

1. Increase the not-to-exceed amount from $97,000 to $147,000 for Fiscal Year 2023-2024; and

2. Extend the term of the agreement by two years to June 30, 2025.


6. APPROVE THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF PALOS VERDES ESTATES AND ROBERT HALF TO PROVIDE SERVICES FOR THE FINANCE DEPARTMENT FOR FISCAL YEAR 2023-2024.

Recommendation: That the City Council authorize the City Manager to the Professional Services Agreement between the City of Palos Verdes Estates and Robert Half Talen Solutions for a not-to exceed amount of $204,000.


7. CONSIDER AMENDING THE PROFESSIONAL SERVICES AGREEMENT WITH TRIPEPI SMITH TO CONTINUE TO PROVIDE COMMUNICATION SERVICES FOR THE REMAINDER OF THE FISCAL YEAR 2023-2024.

Recommendation: Staff recommends that the City Council amend the professional services agreement with Tripepi Smith to increase the compensation amount for Fiscal Year 2023-2024 to $70,000.


8. STATUS UPDATE ON FY 22-23 ANNUAL AUDIT

Recommendation: That the City Council receive and file an update on the FY 22-23 financial audit.


OLD BUSINESS

9. APPROVE THE RECOMMENDATIONS OF THE TRAFFIC SAFETY COMMITTEE DEVELOPED AT THE NOVEMBER 8, 2023 AND JANUARY 16, 2024 MEETINGS RELATING TO TRAFFIC IMPROVEMENTS AT THE INTERSECTIONS OF PALOS VERDES DRIVE WEST/VIA CORTA AND PALOS VERDES DRIVE WEST/PALOS VERDES DRIVE NORTH.

Recommendation: That the City Council approve the recommendation of the Traffic Safety Committee relating to traffic improvements at the intersection of Palos Verdes Drive West (PVDW)/Via Corta, and PVDW/Palos Verdes Drive North (the “Triangle”).


10. ADOPT A RESOLUTION NO. R24-14 TO APPROPRIATE $43,500 IN UNENCUMBERED GENERAL FUNDS (FUND 01) FOR BBK TO RETAIN GEOSYNTEC TO PERFORM ADDITIONAL INVESTIGATORY SERVICES

Recommendation: That the City Council adopts a Resolution No. R24-14 to appropriate $43,500 in unencumbered General Funds (Fund 01) for BBK to retain Geosyntec to perform additional investigatory services.



11. UPDATE ON POLICE COMMUNICATIONS AND ADOPTION OF RESOLUTION R24-13 (1) APPROVING THE PURCHASE OF MOBILE DATA COMPUTERS, INSTALLATION, AND RELATED SOFTWARE COSTS IN AN AMOUNT NOT TO EXCEED $160,000; (2) MAKING AN APPROPRIATION OF ASSET FORFEITURE FUND MONIES NOT TO EXCEED $160,000.00; AND (3) AUTHORIZING THE CITY MANAGER TO EXECUTE RELATED DOCUMENTS ON BEHALF OF THE CITY AND THE FINANCE DIRECTOR TO MAKE SUCH ACCOUNTING ENTRIES FOR THIS PURCHASE AS DEEMED APPROPRIATE.

Recommendation: Staff recommends that the City Council adopt Resolution No, R24-13: (1) approving the purchase of Mobile Data Computers, installation, and related software costs not to exceed $160,000 (2) making an appropriation from Asset Forfeiture fund monies not to exceed $160,000 and (3) authorizing the City Manager to execute related documents on behalf of the City and the Finance Director to make such accounting entries for this purchase as deemed appropriate.


NEW BUSINESS

12. ADOPTION OF RESOLUTION R24-11 (1) APPROVING THE PURCHASE OF A POLICE DETECTIVE VEHICLE IN AN AMOUNT NOT TO EXCEED $47,000; (2) MAKING AN APPROPRIATION FROM THE AB 2766 SUBVENTION FUND IN THE AMOUNT NOT TO EXCEED $47,000 FOR THE PURCHASE OF A CLEAN AIR VEHICLE AND (3) AUTHORIZING THE CITY MANAGER TO EXECUTE RELATED DOCUMENTS ON BEHALF OF THE CITY AND FINANCE DIRECTOR TO MAKE SUCH ACCOUNTING ENTRIES AS DEEMED APPROPRIATE

Recommendation: Staff recommends that the City Council adopt Resolution No. R24-11: (1) approving the purchase of a replacement police detective vehicle in an amount not to exceed $47,000; (2) making an appropriation from the AB 2766 Subvention Fund not to exceed $47,000 and (3) authorizing the City Manager to execute related documents on behalf of the City and the Finance Director to make such accounting entries for this purchase as deemed appropriate.



13. CONSIDER PROPOSALS FOR OBJECTIVE DESIGN STANDARDS FOR SITE REZONING AS PART OF THE SIXTH CYCLE HOUSING ELEMENT

1. Consider Objective Design Standard proposals from De Novo Planning Group and CSG and provide direction to staff; and

2. Consider collaboration with Palos Verdes Home Association (PVHA) on developing the Objective Design Standards per PVHA’s proposal and provide direction to staff.



14. POTENTIAL CODE AMENDMENT REGARDING APPOINTMENT OF CHIEF OF POLICE

Recommendation: Consider whether to amend the Palos Verdes Estates Municipal Code (PVEMC) to require the City Council to concur with the City Manager's appointment of the Police Chief. If said amendment is so desired, staff will return to the City Council with a proposed ordinance amending Palos Verdes Estates Municipal Code (PVEMC) § 2.08.050 (Powers and duties) of Chapter 2.08 (City Manager).
